Chief Justice Gertrude Sackey Torkornoo has dismissed a petition from former Special Prosecutor Martin Amidu calling for the removal of his successor, Kissi Agyebeng.
According to 3 News, Justice Torkornoo concluded that the petition’s factual and legal basis did not meet the necessary standard to establish a prima facie case for the removal of the Special Prosecutor.
The petition, submitted by Amidu on April 30, 2024, and forwarded to the Chief Justice on May 6, 2024, alleged various breaches by the Office of the Special Prosecutor. These included procurement violations in purchasing vehicles, abuses involving judges, and the improper administration of justice. Amidu also accused the office of violating citizens’ rights through unlawful arrests and detentions, infringing on the right to information, and making improper personnel appointments.
Justice Torkornoo’s review found that these allegations were insufficient to warrant further action against Agyebeng. Among the specific claims, Amidu pointed to alleged abuses of power in the arrests of individuals like Cecilia Dapaah and Prof. Frimpong Boateng, arguing that these actions constituted an abuse of office by the Special Prosecutor. However, the Chief Justice determined that the evidence presented did not substantiate the claims enough to proceed with the removal process.
