An urgent application against the arrest of Nandipha Magudumana, a celebrity doctor who is the girlfriend and alleged accomplice of convicted rapist and murderer Thabo Bester, was denied by a South African court.
She requested that the court declare her arrest in Tanzania illegal, claiming that due process was not followed.
While acknowledging that certain aspects of the arrest were flawed, Judge Phillip Loubser concluded that Dr. Magudumana was “aware of the charges that would be leveled against her in South Africa.”
“She agreed to her removal.” I believe the application will fail. “It has been dismissed with costs,” he stated.
Dr. Magudumana will remain in custody and face several charges related to allegedly assisting Bester’s escape from prison last May.
Her legal team has stated that they will study the judgment and follow Dr. Magudumana’s instructions on how to proceed.
“An appeal is not off the table,” her attorney stated.
