The rapper from Atlanta will soon be let go after agreeing to plead guilty to a charge of racketeering conspiracy in the YSL gang case.
According to WSB-TV, he filed a negotiated plea on Wednesday known as an Alford plea in which he admitted guilt to one count of conspiring to break the Racketeer Influenced and Corruption Act while adamantly denying guilt to the related allegation.
Sergio Kitchens, also known as Gunna, received a five-year sentence with one year already served in prison. The 12-month sentence was reduced to time already served.
The final four years of the sentence have been suspended, but there are additional requirements, including 500 hours of community service.
Despite accepting the plea agreement, Gunna declared he would not be working with the prosecution any further. He can invoke the Fifth Amendment, but he must testify if called in order to be released.
In his plea statement, Gunna stated that he had no intention of participating in the trial process in any way. “While I have agreed to always be truthful, I want to make it absolutely clear that I have NOT made any statements, HAVE NOT BEEN INTERVIEWED, HAVE NOT COOPERATED, HAVE NOT AGREED TO TESTIFY OR BE A WITNESS FOR OR AGAINST ANY PARTY IN THE CASE.
Gunna claimed he did not view YSL as a gang when he joined in 2016 and that instead, it was “more like a collection of people from metro Atlanta that shared common interests and artistic objectives.” The rappers who created and delivered music that exaggerated and “glorified” urban life in the Black community were the focus of YSL, he continued.
In the statement he signed, he wrote, “I acknowledge, admit and profoundly apologize that my skill and music inadvertently helped YSL the gang to the harm of my community.” YSL as a gang has to disband.
As part of a broad RICO indictment that also names Young Thug and other YSL members, Gunna was detained in May. The trial is set to start on January 9, 2023.
UPDATE: Gunna has been formally freed from detention. He was observed leaving the Fulton County Jail and entering a Maybach SUV hours after entering a guilty plea to racketeering conspiracy.
